FASCISM This post commences the beginning of a look into the state of musikal freedom in North American today. From Anti-Rave/Anti-Gatherig ByLaws in New York, Chicago, Detroit, Toronto, Vancouver, Richmond, Seattle and San Francisco (to mention only a few places) to the major label pressure on Napster and MP3 musikal freedom, the state of human freedom and one of the primary means of transmission and action of that human freedom -- musik-- and all that entails (dancing, gathering, listening, producing, distributing) is under fierce attack. We begin by looking at Toronto's Raves Act 2000, a ByLaw that will, and already has, effectively quashed an internationally recognised scene. Of course the larger commercial operations are affected, and in many cases has little sympathy for those "cashing in" on the rave-fad. , afterall, takes a large part in de-constructing what was once the "rave." However, the institution of Laws that recognise a loose definition of "raves" hurts ALL gatherings of people, commercial or "underground." The Permit process now in place in many cities leaves no provision for the underground and smaller events. In fact, many of these ByLaws, although initially destructive, give the power of the Courts to Rave Corporations, as they can now argue in Court over the wording of the Law. These Rave Corporations/Companies of course have the capital to pursue such avenues. We-- the underground --do not. We cannot argue the Law nor can we afford to pay for the legal process, the costs of the permits, and the ridiculous costs of a required police presence (and bribes) for what is a private, small gathering. Permits and the rave scene are not mutual. Therefore we enter a new phase of musikal resistance. A phase where we actively pursue an agenda far more dangerous than the original creation of the rave-TAZ. An agenda that instead pursues the deconstruction of that TAZ, the flipping, turning, auto-reversing of that mentality into the EveryDay. In a way, we actively pursue the deconstruction of the "rave scene." In doing so, we alight from the ashes in new forms of resistance that the Law will not recognise. We refused to be recognised. Are we dancing, officer? Prove to me that we are dancing. The fascism that lurks behind these Laws is part of a larger symptom gripping North America. It is a resurgence of Conservatism, yet a Conservatism linked to corporations. Perhaps "Corporate Fascism" would be the best term for this phenomena. In the past, Fascism sounded like this: "In Germany they first came for the Communists, and I didn't speak up because I wasn't a communist. Then they came for the Jews, and I didn't speak up because I wasn't a Jew. Then they came for the Trade Unionists, and I didn't speak up because I wasn't a Trade Unionist. Then they came for the Catholics, and I didn't speak up because I was a Protestant. Then they came for me, and by that time no one was left to speak up." - Pastor Martin Niemoei And now, Fascism-Lite, aka Corporate Fascism: "American political scientist Michael Parenti has pointed out that most historians of Hitler-era Germany tend to focus on the Nazis' goose-stepping parades and the F№hrer's ranting speeches -- the pomp and ceremony, in other words. What most fail to examine, says Parenti, is the Nazis' social and economic agenda, which was designed to slash social programs, crush trade unions, drive the working poor into greater poverty and ultimately transfer more wealth and power to corporations and the rich. The Toronto Anti-Rave Act] ((( commentary in parantheses [ ]. ))) [TORONTO] - Bill 73 2000 "An Act to promote public peace and safety by regulating lateЦnight dance events" This act uses loose wording to effectively shut down or enter any event or space with people without due process. This Act flies in the face of the Canadian Charter which asserts the Right to Assembly. Below are the most important excerpts: - "rave" means an event with all of the following attributes: 1. Any part of the event occurs between 2 a.m. and 6:00 a.m. 2. People must pay money or give some other consideration to participate in the event. [What is "other consideration?"] 3. The primary activity at the event is dancing by the participants. 4. The event does not take place in a private dwelling. [Could be a loophole-- ie an artist's studio.] Prohibition 2. (1)?No person shall hold a rave unless the person holds a permit for the rave. [Forget throwing any event under 5000 people in order to pay for this.] Promotion and ticket sales (2)?No person shall promote or organize a rave, or offer, distribute or sell tickets to a rave, unless a permit has been issued with respect to the rave. [This makes promoting an event before you get the permit illegal. The permit process in Toronto has been incredibly slow. You also cannot book your space before receiving the permit. This makes an organizational nightmare.] Use of property (3)?No person shall allow property to be used for the holding of a rave unless a permit has been issued for the rave. [This tramples upon the rights of propery owners.] Permits prohibited (2)?A municipality shall not issue a permit in any of the following circumstances: 1. The past conduct of the applicant affords reasonable grounds for belief that the applicant will not carry on business in accordance with the law and with integrity and honesty. [Very loosely defined. This could be read as "you've thrown raves before the permit process existed, therefore that was illegal, and so you aren't going to get one now"] 2. Within six months preceding the date of the application, the applicant has been convicted of an offence under this Act, or the Controlled Drugs and Substances Act (Canada). [Drug information is private and should have NOTHING to do with this Act.] 3. Within six months preceding the date of the application, a person has been convicted of an offence occurring at a rave held by the applicant under, i. the Liquor Licence Act, ii. the Fire Protection and Prevention Act, 1997, iii. the Health Protection and Promotion Act, iv. any byЦlaw concerning the regulation of noise, maximum occupancy, or fire safety, [Received one noise complaint last time? Then no permit.] v. the Controlled Drugs and Substances Act (Canada), or vi. the Criminal Code (Canada). [If you are a protester and been arrested on activist charges? No permit.] 6. It is not in the public interest to issue the permit having regard to the needs and wishes of the residents of the municipality in which the premises are located. [Easy excuse to shut it down. "Not in my backyard" philosophy.] Permits suspended or revoked (8)?A municipality may suspend or revoke a permit for any ground set out in subsection (2) by which it could decline to issue a permit. [Notice there is no timeline. Meaning that a fully permitted event could be shut down if ONE resident complains the night of the event.] Inspections 5. (1)?For the purpose of ensuring compliance with this Act, a police officer may, without warrant or court order, enter any place where the police officer reasonably believes that a rave is being held in contravention of this Act or a byЦlaw under this Act. [THIS effectively gives complete Search power to ANY officer who happens to believe there might be a "rave" going on, regardless of the nature, the privacy or the location of the event. This section skips the due process of a court order.] (2)?During an inspection under subsection (1), a police officer may, (a) make reasonable inquiries of any person; and (b) require the production for inspection of any document or thing that may be relevant to the inspection. [What is a "thing" ? What is a "reasonable inquiry?" Is that like "reasonable force" that can now be used to get DNA samples?] Offence 8. (1)?A person is guilty of an offence who, (a) knowingly furnishes false information in any application under this Act; (b) contravenes subsection 5 (4) or fails to vacate the premises in accordance with a direction given under subsection 7 (1); or [This means that if you are shut down, and need to stay to clean up, you could be arrested for "failing to vacate the premises."] (c) contravenes section 2, subsections 5 (1), 7 (2), any condition of a permit, or any byЦlaw. [ANY BY-LAW?? ANY condition of a permit? Ie., if you put out a pre-flyer before your event has been permitted, you could face arrest.] Penalties (3)?Upon conviction for an offence under clause (1) (a) or (c) or subsection (2), (a) a corporation is liable to a fine of not more than $50,000; and (b) an individual is liable to a fine of not more than $10,000 or to imprisonment for a term of not more than six months or both. [The consequences are drastic. Throwing a 500 person event and can't afford the permit and police bribery? You could go to jail plus end up in serious debt. This Act destroys the underground outright.] ------- [3. A Response from Richie Hawtin's Mother] Brenda Hawtin, LaSalle Ontario, Canada _____________________________________________ My name is Brenda Hawtin, parent to Richie Hawtin, international dj, successful businessman and ambassador for Windsor. He, Rich, is also involved in rave parties. I recently attended Sandra Pupatello's presentation at the Capitol Theater of her new video, Dancing in the Dark. The video has been shown to Grades 7 through Grade 9, telling them of the dangers of attending rave parties, as these parties promote and supply the drug "ecstacy". As a parent, I know full well the worries and concerns all parents have whenever drugs are involved, I know what lengths we will go to protect our children from drugs. But I feel I must inform parents that the raves kids so very much enjoy do not encourage kids to take drugs. Far from it. Before entering, the kids are frisked and, if any drugs are found, they are turned away. If anyone is caught taking any illegal substance, including liquor, they are escorted out. Police and security are hired, and a member of the medical world is always on hand. I guess what I am trying to say is, it is not raves that make kids take drugs. Kids who take any illegal substances take them, rave or not. Unfortunately, drugs are widely available, from school grounds to public parks. We as parents must become more vigilant to take time to be there for our kids, to learn to listen to them and even to put our own lives on hold for a while to do our job as parents. The teenage years are special years - our offspring are flexing their wings, preparing to fly. But they still need us so very much while they experiment with life. We should encourage them to explore and investigate, and if we have done our job well and given them the knowledge and ability to know right from wrong,let them know we will be there for them. We should not be afraid to let them enjoy the odd rave or two. So, they may be out until the early hous of the morning dancing the night away. As long as you know where they are- and they are aware you know - and you show them some trust. There has been so much negative press recently about raves, I can understand a parents concern. The last thing any parent wants is a child overdosing - or worse. We must teach our kids about the dangers of drugs. But do not tie them entirely to raves. Drugs are everywhere and if your kid wants to take drugs, they will obtain them, rave or not. So please, Ms. Pupatello, lay off the rave crowd and put that energy into educating our kids and parents about life, drugs and parenting. [2. The Toronto Anti-Rave Act]

[TORONTO] - Bill 73 2000
 
"An Act to promote public peace and safety by regulating late–night dance events"
 
This act uses loose wording to effectively shut down or enter any event or space with people without due process. This Act flies in the face of the Canadian Charter which asserts the Right to Assembly. Below are the most important excerpts:
 
-
"rave" means an event with all of the following attributes:
 
1. Any part of the event occurs between 2 a.m. and 6:00 a.m.
2. People must pay money or give some other consideration to participate in the event. [What is "other consideration?"]
3. The primary activity at the event is dancing by the participants.
4. The event does not take place in a private dwelling.
[Could be a loophole-- ie an artist's studio.]
 
Prohibition
2. (1)?No person shall hold a rave unless the person holds a permit for the rave.
 
[Forget throwing any event under 5000 people in order to pay for this.]
 
Promotion and ticket sales
(2)?No person shall promote or organize a rave, or offer, distribute or sell tickets to a rave, unless a permit has been issued with respect to the rave.
 
[This makes promoting an event before you get the permit illegal. The permit process in Toronto has been incredibly slow. You also cannot book your space before receiving the permit. This makes an organizational nightmare.]
 
Use of property
 (3)?No person shall allow property to be used for the holding of a rave unless a permit has been issued for the rave.
 
[This tramples upon the rights of propery owners.]
 
Permits prohibited
(2)?A municipality shall not issue a permit in any of the following circumstances:
 1. The past conduct of the applicant affords reasonable grounds for  belief that the applicant will not carry on business in accordance with  the law and with integrity and honesty.
 
[Very loosely defined. This could be read as "you've thrown raves before the permit process existed, therefore that was illegal, and so you aren't going to get one now"]
 
2. Within six months preceding the date of the application, the applicant has been convicted of an offence under this Act, or the Controlled Drugs and Substances Act (Canada).
 
[Drug information is private and should have NOTHING to do with this Act.]
 
3. Within six months preceding the date of the application, a person has been convicted of an offence occurring at a rave held by the applicant under,
i. the Liquor Licence Act,
ii. the Fire Protection and Prevention Act, 1997,
iii. the Health Protection and Promotion Act,
 iv. any by–law concerning the regulation of noise, maximum occupancy, or fire safety,
 
[Received one noise complaint last time? Then no permit.]
 
v. the Controlled Drugs and Substances Act (Canada), or
vi. the Criminal Code (Canada).
 
[If you are a protester and been arrested on activist charges? No permit.]
 
6. It is not in the public interest to issue the permit having regard to the needs and wishes of the residents of the municipality in which the premises are located.
 
[Easy excuse to shut it down. "Not in my backyard" philosophy.]
 
Permits suspended or revoked
(8)?A municipality may suspend or revoke a permit for any ground set out in subsection (2) by which it could decline to issue a permit.
 
[Notice there is no timeline. Meaning that a fully permitted event could be shut down if ONE resident complains the night of the event.]
 
Inspections
5. (1)?For the purpose of ensuring compliance with this Act, a police officer may, without warrant or court order, enter any place where the police officer reasonably believes that a rave is being held in contravention of this Act or a by–law under this Act.
 
[THIS effectively gives complete Search power to ANY officer who happens to believe there might be a "rave" going on, regardless of the nature, the privacy or the location of the event. This section skips the due process of a court order.]
 
(2)?During an inspection under subsection (1), a police officer may,
(a) make reasonable inquiries of any person; and
(b) require the production for inspection of any document or thing that may be relevant to the inspection.
 
[What is a "thing" ? What is a "reasonable inquiry?" Is that like "reasonable force" that can now be used to get DNA samples?]
 
Offence
8. (1)?A person is guilty of an offence who,
(a) knowingly furnishes false information in any application under this Act;
(b) contravenes subsection 5 (4) or fails to vacate the premises in accordance with a direction given under subsection 7 (1); or
 
[This means that if you are shut down, and need to stay to clean up, you could be arrested for "failing to vacate the premises."]
 
(c) contravenes section 2, subsections 5 (1), 7 (2), any condition of a permit, or any by–law.
 
[ANY BY-LAW?? ANY condition of a permit? Ie., if you put out a pre-flyer before your event has been permitted, you could face arrest.]
 
Penalties
(3)?Upon conviction for an offence under clause (1) (a) or (c) or subsection (2),
(a) a corporation is liable to a fine of not more than $50,000; and
(b) an individual is liable to a fine of not more than $10,000 or to imprisonment for a term of not more than six months or both.
 
[The consequences are drastic. Throwing a 500 person event and can't afford the permit and police bribery? You could go to jail plus end up in serious debt. This Act destroys the underground outright.]

My name is Brenda Hawtin, parent to Richie Hawtin, international dj, successful businessman and ambassador for Windsor. He, Rich, is also involved in rave parties. I recently attended Sandra Pupatello's presentation at the Capitol Theater of her new video, Dancing in the Dark. The video has been shown to Grades 7 through Grade 9, telling them of the dangers of attending rave parties, as these parties promote and supply the drug "ecstacy".
 
As a parent, I know full well the worries and concerns all parents have whenever drugs are involved, I know what lengths we will go to protect our children from drugs. But I feel I must inform parents that the raves kids so very much enjoy do not encourage kids to take drugs. Far from it. Before entering, the kids are frisked and, if any drugs are found, they are turned away. If anyone is caught taking any illegal substance, including liquor, they are escorted out. Police and security are hired, and a member of the medical world is always on hand. I guess what I am trying to say is, it is not raves that make kids take drugs. Kids who take any illegal substances take them, rave or not. Unfortunately, drugs are widely available, from school grounds
to public parks.
 
We as parents must become more vigilant to take time to be there for our kids, to learn to listen to them and even to put our own lives on hold for a while to do our job as parents. The teenage years are special years - our offspring are flexing their wings, preparing to fly. But they still need us so very much while they experiment with life. We should encourage them to explore and investigate, and if we have done our job well and given them the knowledge and ability to know right from wrong,let them know we will be there for them. We should not be afraid to let them enjoy the odd rave or two. So,  they may be out until the early hous of the morning dancing the night
away. As long as you know where they are- and they are aware you know - and you show them some trust. There has been so much negative press recently about raves, I can  understand a parents concern. The last thing any parent wants is a child overdosing - or worse.
 
We must teach our kids about the dangers of drugs. But do not tie them entirely to raves. Drugs are everywhere and if your kid wants to take drugs, they will obtain them, rave or not. So please, Ms. Pupatello, lay off the rave crowd and put that energy into educating our kids and parents about life, drugs and parenting.
